Committee OKs use of $23M in SPLOST money to close gap

MARIETTA - The Cobb School District's SPLOST oversight committee voted Monday to recommend that the school board declare $23 million in excess funds from SPLOST II to be moved to the general fund and used for the fiscal year 2011 budget.

David Wilkerson, the Facilities and Technolgy Committee's treasurer and the former chairman of the Cobb Democratic Party, made the motion. The only committee member to vote no was Kimberly Euston, a member appointed in January by school board member Dr. John Crooks.

Following the meeting, Euston said she has reservations about the legality about the process.

The board last week approved a tentative budget of $819.4 million for FY11, which begins July 1. In addressing a $126.7 million budget deficit, the proposed budget includes a property tax increase of 1.1 mills, to the maximum allowable rate of 20 mills. But Superintendent Fred Sanderson has put forth a proposal for the board to immediately vote to reduce the millage rate back to 18.9 mills, which would subsequently free up the $23 million in excess funds in SPLOST II. The phantom tax hike would not actually raise property taxes, but would reportedly be a legal way for the district to gain more money in its general fund for the FY 11 budget. By law, the school board is only allowed to do one of two things with excess SPLOST money - either pay off debt or to pay down the millage rate.

Euston said, "I still think there's a bit of uncertainty that this is something we can do. That question went unanswered... And I'd rather build classrooms with it."

While Board Chairwoman Lynnda Crowder-Eagle, who was at the Monday night meeting, told members that the legality of the phantom tax hike had been approved by district attorney Glenn Brock, Euston and other members questioned whether it would be the best course of action considering the district's past lawsuits regarding SPLOST expenditures.

Legality of the use of SPLOST dollars has been questioned several times before and created lawsuits for the district, most recently in the area of using SPLOST money to install artificial turf at the district's 16 high schools.

The board is set to vote on the excess funds measure at its May 27 meeting.

Also Monday, Wilkerson, who was appointed by school board member David Morgan, brought up the need to improve communication between the board and the F&T committee. Wallace Cooperwood, a 13-year committee member appointed by Sanderson, was rather critical of what he called a recent lack of communication from the board.

"I think that there's a lot of cherry-picking from the board to what they want to send before this committee," Cooperwood said.

Cooperwood and the other F&T members encouraged the board liaison to create a way to communicate F&T recommendations with the rest of the board. Committee member Angie May, a Cheetham Elementary School mom, suggested that Banks give a report to his fellow board members at board meetings, a tradition began by his board liaison predecessor, Crooks.

Best bet for Oakwood HS:

TELL them that with all of the increase in class size, wouldn't it be nice to encourage and send students to Oakwood High School? Wouldn't they like to not increase the drop out rate and to keep their AYP looking squeaky clean next year?

Here we go again..rob Peter to pay Paul! Why should Sanderson care if it is legal? How much of a pay cut did he take??? How many furlough days? What about the board? Are they taking furlough days? Teachers are underpaid for the hours they work already. Most are just trying to get by. Most teachers are good people that teach for the love of teaching, not the money, but how long can you work for peanuts? and then have zookeepers take that away too?? Get real people..it's not about the money it's about the KIDS! Someone needs to figure out how to keep teachers in the classrooms or our country is going to fail!!

Mike Johnson...who are you? What do you know about the teachers in Cobb? As a matter of fact, I never made a "C" in my school years. I had a 4.3 grade point average in high school, attended two excellent universities (The College of William and Mary and The University of Virginia) and earned a 3.5 and 3.7 GPA respectively for my Bachelor's and Masters degrees. The teachers that I work with attended universities such as Wisonsin, Purdue, UGA, Iowa, etc. and were excellent students.

Just because your friends are not bright (which is likely the case with you, as well), do not presume that the teachers in Cobb fall under that same category. I would be glad to match wits with you, but I do not believe in fighting an unarmed man.

And by the way, your comment that "cuts can be made at all levels with very little discernible change in outcome" would be laughable if it were not so ignorant. You actually think cutting teachers as the Board has and increasing class sizes to 35 students per class will have no real impact? That is ludicrous statement at best. Student learning will be greatly affected by increasing class sizes to unmanageable levels. Obviously you have never tried to teach a group of people other than your own children, who I pity.

I hold no hatred toward people. I do, however, despise attempts to harm based in misinformation. Blogs are notorious for that.

Is this even legal? I thought the SPLOST money was only supposed to be used in the manner in which it was proposed, then voted on by the citizens of this county.

A few random thoughts: 1) How much of the budget deficit goes to educating illegals? 2) Most teachers I know were the C students I went to school with. The A and B students get jobs in private industry. 3) This entire school board needs to be turned out. 4) Especially Sanderson. 5) Public education is a bloated government institution. Cuts can be made at all levels with very little discernible change in outcome. 6) If you value your child's education, you will send them to private school or homeschool.

Dear Fred,

I'm sure the teachers are ticked off at you for once again lowering their pay. Here's a little tip to help save some face. Take 20% off of your pay before you lower theirs. If you have the GUTS to do that it may help.

Well 2% and some furloughs in nothing compared to the 100% I lost when I was laid off from Cobb County last year in the first round budget cuts that hit technology, but I wasn't on here complaining. I had to find a new job. Just want people to look at the other sides perspective.

The fact of the matter is that we are now without 500-plus full-time teachers and almost that many part-time teachers. We are now looking at 40 children in a class. The SPLOST manuever will add money to the 2010-2011 budget and these teachers have been eliminated from the 2010-2011 budget. I volunteer in the schools and I can tell you right now, that number is going to be harmful beyond what even you can comprehend. By the way Big D, these beautiful schools that we have built all around the county are not designed to hold 40 kids in a class....so rest assured someone is going to be asking for some of the SPLOST money to build new schools.....and so the cirlce continues.

If you are not a teacher, please do not think you remotely understand our position. This is NOT the first year we are receiving cuts. Year after year, we have received increase in benefits. In addition, we do not receive bonuses and pay raises like the business sector. Some teachers may not receive a step increase for 4 to 5 years. That equates to taking home less and less money each year due to the benefits increases. Then the step increase comes, and they are equal to what they were 4 years ago. As for the board, they knew this was coming and did NOTHING about it. They are not increasing the millage, Cobb Delegation will not repeal the senior tax, thus there is not a solution anywhere. After this coming school year of 30- 40 kids in a class, all of you who are complaining that teachers whine too much, will be the first to scream about your children not receiving a quality education. CCSB is way over their heads in trouble, and they are ruining the school districts reputation!

John R- "Skirting" the law results in a reversal decision by a judge... then, possibly, retribution against the members of the Board. If the public truly sees it that way, it'll be played out in a law suit and ultimately determined by a judge.

As to your "NOT ONE" teacher comment... you make NO SENSE. The concept has been discussed, not action taken. Therefore, NOT ONE dollar has moved yet. Therefore, no impact of any kind could be reasonably expected. Once again, your spin.

You do realize that a 2% pay cut, five furlough days, and a decrease in the local supplement will result in the loss of THOUSANDS of dollars in salary for most teachers? And yes that does hurt especially when both of the bread winners are teachers. I understand that many people think that teachers are whining, but believe it or not, most of don't make Fred Sanderson money. Add it up and my family will lose a hefty percentage of its income this year. But hey, who cares. Teachers aren't important right?

Circumventing the spirit and intent of he SPLOSH law is typical of shady and questionable legal advice form Brock and Clay - there will be future consequences for such behavior by the CCSB. When will they reduce the $2,000,000 that the lawyers take home each year. furlough them, heck no, fire them !

Big D - if skirting the law is acceptable to you than so be it. Just don't expect the voters to go along with many more SPLOST adventures. And, while you may think otherwise, NO teachers were spared because the SPLOST funds became available...NOT ONE. If you want revenue for the district then start pushing the Cobb County delegation to find a way for us to retain the hundreds of millions we send to the the state to keep the other counties afloat. Of course, the troubles between the legislative delegation and the Cobb County schools has only gotten worse with the current school board, so don't look for them to push too hard.

JohnR2 - I have no clue who you are, but for future reference I will use a different name because I would hate for you to have to explain anything to anyone....being that perhaps you are the one without a clue.

If a 2% paycut and a couple furlough days are going to cause you to lose your house, you are leaving beyond your means. Thats half of the reason the economy is what it is.....

Or to put it another way, Crooks would do anything (within the law) to help keep more teachers.

Spin. That's all you're about. This board is supposed to help find money to run the district, preventing as many layoffs as possible, while Ga's Legislators rob our funds to send to Podunk Co. and Cobb property tax revenues plummet.

Got any other ideas for legitimate revenue sources or are you just too busy trying to demonize the members of this board to deal with that reality?
