Cobb sheriff assails ACLU 287(g) claims

MARIETTA - Cobb Sheriff Neil Warren responded Thursday to accusations made by the American Civil Liberties Union last month regarding the 287(g) program. Warren said his department does not abuse 287(g), which is an agreement with the U.S. Immigration and Customs Enforcement Agency to check the immigration status of everyone booked into the county jail.

Warren signed a new 287(g) agreement in October with the unanimous consent of the Board of Commissioners. That same week, the ACLU issued a report arguing that "unchecked police power under 287(g)" is tearing apart families in Cobb.

"The ACLU report continuously confuses the roles of several law enforcement agencies in Cobb County. For example, the ACLU report suggests numerous times that the Cobb County Police Department abuses authority granted under the Memorandum of Agreement (MOA)," Warren said in the response.

"This assertion by the ACLU is a blatant misstatement of the facts because, as the ACLU well knows, the MOA does not grant any authority to the Cobb County Police Department and has no legal impact whatsoever on that agency's operations. The ACLU either does not understand the relationship between the various law enforcement agencies or is deliberately attempting to mislead readers about how the 287(g) program works in Cobb County."

The ACLU report states: "Cobb County residents who appear to be foreign-born have been subjected to rampant racial profiling and are routinely picked up by the police for minor or nonexistent violations."

Officers do not target a specific group of people, Warren said.

"If racial profiling played a role in the arrest of an individual - and there is no substantial evidence that such has occurred - it would have happened during the arrest procedure by an agency that has no authority under 287(g)," he said. "Moreover, the ICE-certified Sheriff's deputy performing 287(g) functions does not make arrests and therefore cannot be accused of racial profiling."

In response to the ACLU's accusation that individuals are arrested on minor traffic violations, Warren said, "The report does not mention the number of non-Latino people who were stopped and arrested or released for similar violations. These unsubstantiated accusations hardly rise to the level of credible proof that Cobb residents who appear to be foreign born have been subjected to rampant racial profiling and are routinely picked up for non-existent violations."

The Cobb County Sheriff's Office was the first agency in Georgia to participate in 287(g). Since July 2007, Warren's office has identified more than 6,600 inmates who were in the United States illegally.

The Sheriff blasted the report, calling it baseless.

"Other than to simply state that the 287(g) program encourages bad acts by law enforcement, the ACLU has offered no data or other information that there is any kind of relationship between the existence of the 287(g) MOA and the acts of which it complains," he said. "Indeed, the ACLU report offers nothing, other than unsubstantiated anecdotal references, concerning racial profiling. Overall, the contents of the ACLU report totally lack any justification to refrain from implementing the provisions of the Section 287(g) program in Cobb County."

Amazing the ACLU siding with illegals. Its apparent that they and others are making money off the illegals. So the Sheriffs Dept found over 6000 illegals in their jail since 07, big deal, they were there because they broke the law twice, the first time entering this country illegally.

They come here, live off the government, pop out babies that automatically become citizens and send their money home, so what good are they to us other than cheap illegal labor amd a burden on our tax base. DEPORT!!!!!!

It is not a surprise that the ACLU never represents law abiding, citizens and taxpayers who have been wrongly accused or injured or killed by criminal illegal aliens. The ACLU unfortunately is funded by the American taxpayer and they choose to use that funding to undermine the fabric of our society.

We admire Sheriff Warren and the difficult job performed by his deputies, one of whom was recently killed by a drunk illegal who ran away and left him to die alone in a ditch.

MK-those supporting illegals get it too. They are building their dependent following. The liberal gov't officials along with the media are running a constant campaign to brainwash those who can't think for themselves & want the gov't to supply everything for them. The tragic, frightening thing is, it seems to be working. Will the apathetic, silent majority wake up & preserve this country or will they allow the U.S. to be given away?

How convenient that the ACLU accuses the Sheriff and his officers of "tearing apart families" simply because these officers are following the laws. If these people had not broken the law in the first place and come here illegally, there would be nothing to tear apart. After all, these "families" are more than welcome to join the family member who has been returned to where they belong at least until they find their way back again, and the majority of them will. If there was profiling, the police would be in every shopping center, at every QT and Racetrack gas station, and at the parks which are being taken over by aliens, both legal and illegal I presume. It always amazes me when the ACLU accuses law enforcement of breaking the law, but never those who make these actions necessary. We are behind you Sheriff, keep up the good work. The citizens appeciate you, your deputies and staff - and will keep you in office - at least until these ilelgals get the right to vote, which I am sure will happen very soon.

Sheriff gets it!

So many elected officials don't.

The drug cartel set up shop quite easily in the house next to me in Cobb,.... no one there in my own country to protect me. I had to sell my house & move.

The illegals have taken over the constuction industry (my career choice) making it next to impossible to earn a living wage any longer.

I've lost my American dream!! How many others? That story doesn't get reported by our PC media!

If you're here w/out proper documentation, you're illegal. If you're here from Germany, the U.K., Iran ,Mexico, etc., etc., illegally,... there should be no-one protecting your law breaking ways. South Cobb Drive didn't get in the condition it's in from 'legal' immigrants moving into the area. There are parts of Gwinnet County , Rockdale County, Hall County, etc., etc., that are unrecognizable as American communities.

Other countries protect their borders & don't make apologies about it. It's a survival technique. Americans don't have the will to survive.

Does the ACLU not realize the CC Sheriff's department normally does not conduct traffic stops...that is the role for CC Police.
