Warrant: Two men had pot in bathroom at closed public park

SMYRNA — Two young men from Marietta were arrested in Smyrna last week after police say they were using marijuana at a closed public park.

Jose Rubio, 18, and Jose Ibarra, 18, were with an unnamed woman when they were arrested by Cobb County police on Nov. 20, according to a warrant.

The men were off the Silver Comet trail near Concord Road, which is a “particular trail head known by Cobb Police Rangers as a common area for drug use and graffiti,” the warrant stated.

An officer noticed a vehicle that was still warm parked alongside a maintenance shed and bathrooms, the warrant stated.

While in the area, the officer heard a female voice coming from the men’s bathroom, the warrant stated.

The door was locked, and when the officer began kicking in the door he heard the sound of a toilet flushing, the warrant stated.

“A residual amount of marijuana was located on the toilet seat and sink that was subsequently taken for testing,” the warrant stated.

Both men were arrested on three misdemeanor charges of possession of less than an ounce of marijuana, loitering and tampering with evidence.

Both men were released two days later on $2,000 bond, but Rubio’s case was reviewed by the U.S. Immigration and Customs Enforcement agency.
