John Kristofak - Cobb County Sheriff's Office
John S. Kristofak, 58, has been charged with malice murder, felony murder, aggravated assault, burglary, aggravated stalking and two firearms-possession charges.
The indictment was handed down Thursday.
According to a release from Cobb County District Attorney Vic Reynolds’ office, they believe Kristofak killed his former wife, Donna Nations Kristofak, at her east Cobb home in the 3900 block of Tall Pine Drive on Dec. 22.
After a five-day search, Kristofak was arrested at a motel in Union City, 30 miles south of Marietta.
He continues to be held without bond in the Cobb County Jail.
Reynolds and Chief Assistant District Attorney Don Geary are prosecuting the case, which is assigned to Cobb Superior Court Chief Judge Adele Grubbs.
Mitch Durham, a Marietta attorney, has been appointed to represent Kristofak.
If Kristofak is convicted of all charges, he could face a maximum penalty of life in prison without the possibility of parole, plus 40 years.
His next scheduled court appearance is at 9 a.m. March 20 before Grubbs for a probation revocation hearing on previous stalking charges.
Kristofak had pleaded guilty to aggravated stalking and family violence simple battery charges on Oct. 12.
Grubbs sentenced him to four years and five months probation and seven months in jail, with credit for the time he already served.
He was also given a permanent restraining order, forever banning him from contacting or going within 500 yards of his ex-wife.

The legal system would like to believe that in most cases releasing doesn't result in this type of outcome. Their basis is to narrow and their risk our lives. The above incident happened in NY. We saw a similar incident here but with more direct evidence of the outcome. The legal system needs to take off the blind fold and open its eyes.
