MARIETTA — A Marietta man severely injured in an attack on the Penske truck-rental facility in January 2010 has filed a $20 million lawsuit against businesses related to the Penske facility and accused shooter Jesse James Warren.

Zachariah Werner, 37, and his wife, Jodi, filed the suit June 16 in Gwinnett County State Court against Penske Truck Leasing Corp. Inc.; Rollins Leasing Corp.; Rollins Leasing LLC; and Warren. The registered agents for the three corporate defendants are in Norcross, according to the suit.

The Rollins firms own the property in Kennesaw where police say Warren went on a shooting rampage on Jan. 12, 2010, killing three people and injuring two, according to the suit.

Penske Leasing Corp. had its operations on the site, but is not the same company that employed Werner, according to the suit. State law prohibits anyone receiving worker’s compensation from suing that employer.

Werner was left with a bullet lodged in his brain stem and is unable to function in any normal manner, the suit claims. He cannot breathe or communicate on his own, must use a feeding tube, is bedridden, and will require continuous medical treatment for the rest of his life, according to the suit.

A spokesman for Penske said only that the company is evaluating the lawsuit. The defendants have 30 days to file their answer with the court.

Attorney R. Keegan Federal Jr., a former DeKalb County Superior Court Judge and founder of the Federal & Hasson law firm in Atlanta, filed the suit on behalf of the Werners.

Werner, he said, cannot speak or perform any bodily functions on his own.

“He is conscious, and he can occasionally blink his eyes,” Federal said. “That tells us his brain is still in there, but he has that bullet lodged in his brain stem.”

Werner had worked for Penske Truck Leasing Co. L.P. since October 2005, while Warren, the accused gunman, worked for that firm from June 2005 to July 2008, according to the suit.

The suit alleges that the defendants were warned “on numerous occasions” that Warren had plans to kill people at the site but “failed to provide adequate security and safety,” despite employing security guards for a time.

The suit also claims that Warren was diagnosed as a paranoid schizophrenic in 2005 and that he had received psychiatric treatment at the request of the Penske defendants.

Werner’s wife, Jodi, has become a certified nursing assistant and provides much of her husband’s care, which means she is unable to work outside the home, Federal said. The couple has three children who range in age from 12 to 17.

Worker’s comp is covering most of the family’s medical bills, Federal said, though “there are some needs that they have, such as a van to be able to transport Zach to rehab, that we hope the suit will be able to provide them and improve their quality of life.”

As of Tuesday, Federal said, he is also co-counsel with attorney Mark Tate, of Savannah, in lawsuits filed by Joshua Holbrook, the other survivor of the Penske attack, and widows of two of the men who died. Van Springer, Roberto Gonzales, and Jaider Marulanda were killed in the attack.

Warren has pleaded not guilty to murder charges. District Attorney Pat Head is seeking the death penalty.

Are you people serious? You could NEVER begin to imagine what this family has been through! They have watched their dad and husband fight for his life for the past year and a half. Kids who are no longer able to have a conversation or support from their daddy, no longer to get a hug or have him give them words of wisdom or just have him say HI to them when they walk in the door! A wife who has been with him since high school, no longer to have her man by her side, she hasnt heard his voice in a year and a half, no hugs, no kisses, no touches, no loving support! Watching the man she loves go through surgey after surgery never knowing if he is going to make it through the night.... can you really put a price on that? I DON"T THINK SO!!! Try all you want, you will never be able to comprehend the anguish this family has endured! And if you have sen the other articles or news, they are suing the shooter as well. Get your facts straight before you attacking people that you know NOTHING about! No wonder this poor family has tried to stay out of the eyes of the media!!

And really you people need to grow up and get your facts straight before you start criticizing people! Have you thought maybe just maybe that upper management, the ones who knew about the threats did not tell their employees what threats this man had made? You are seriously going to judge them for what they have on in a picture, which I'm pretty sure they NEVER thought would be on the news or in the paper anyway! And put your glasses on Hopeful again... he is wearing a HAT not a RAG! But who cares if he was, who the heck are you to judge??

Werners, you guys fight and win that lawsuit!! In my opinion 20 million is not enough!!

Wow - I'm hopeful again that there are responsible adults in the world by just reading these comments. Thanks guys.

YOU see there is a crazy person and YOU know YOU are in danger then YOU LEAVE the situation. YOU don't continue to ask someone to protect YOU. YOU continued to go to this employeer and YOU got shot. It was NOT the employeers responsibility to protect YOU. Grow up and take a picture without the rag on your head and think before YOU put YOURSELF and YOUR family in danger. I'm sorry Penske is not at fault nor Rollins Leasing - YOU and the crazy laws that protected the sick and left Penske & Rollins Leasing powerless to protect their property.

First of all I want to say I'm sorry for your loss - nothing will help with the pain.

this is what is wrong with our legal system. the company couldn't do many things to get rid of this employee because it would be discrimination.

Penske was damned if it did something and damned if it didn't. sounds like they did do something,

If the employees were so afraid of this person and they think that Penske should have known that something like this was going to happen - then the employees should have known too and left the company to seek employment elsewhere. Did that happen.

Point is NO on can predict the future - and our legal system loves to point out all the things we could have done differently - in hindsight!

It is just plain wrong!

$20 million? For What??? I'm sorry for his family's loss, but it's not Penske's fault. Wait, you only sue people with money, not the broke loser who pulled the trigger. Another example of someone looking for an easy way to make someone else support his worthless existence.

As John Mellencamp would say, "Ain't that America". Three dead and one life destroyed by a mentally disturbed man with a handgun. What else is new? Those at fault are not the people at Penske but those politicians and lobbyists who permit a paranoid schizophrenic receiving psychiatric treatment to own a firearm. We see these tragedys on an all too frequent basis. Sadly we will continue to see these events as long as the gun lobby continues to grease the palms of crooked politicians.

P.S. Nine year old Christina Taylor Green is still dead!
