Police: Teen had pistol, 3.5 grams of pot

SMYRNA — Darryl Payne, 17, of Marietta, was arrested on two misdemeanor charges of possession of a pistol by a minor, his first offense, and possession of less than an ounce of marijuana, according to the arrest reports.

On Dec. 31 at 11 p.m., a Smyrna officer was investigating a noise complaint at the Residence Inn off Cumberland Boulevard, were approximately 15 teenagers were having a party, according to the warrant.

When the officer entered, Payne pointed his hand in the officer’s face, simulating a gun.

“Due to the teenagers having gang affiliation a patdown was conducted,” the warrant said.

The officer found a .22-caliber automatic pistol in the left front pocket of Payne’s jeans and 3.5 grams of “raw marijuana inside the left pocket of his shorts, which he wore underneath his jeans,” the warrant said.

Payne was released the next day on a $2,000 bond.
