Kennesaw ethics board member resigns

KENNESAW — City of Kennesaw Ethics Board Member Eileen Alberstadt resigned from her position via email Thursday morning, citing discomfort with Tuesday’s meeting about a complaint against Mayor Mark Mathews.

“The ethics board meeting that took place on Tuesday, (July 24) this month was something that pretty much blindsided me as a board member,” Alberstadt wrote in an email to Kennesaw City Clerk Debra Taylor announcing her immediate resignation.

Alberstadt said Mathews’ presence at the meeting was intimidating.

“I do not feel that there should have been any city council members present also. How unprofessional do you really get? I felt uncomfortable from the moment I walked in the door until I got in my car after the meeting,” she wrote. “I do not feel very ethical about my city anymore nor do I like the backstabbing that is going on.

“It really makes me sick. … Ethics? Ethics? Some higher ups in this City need to really look up the word and abide by it. This all makes me sick.”

The five-member board met for about an hour and ultimately dismissed Georgia EMS employee David Ermutlu’s complaints that Mathews had performed personal business over government email and did not recuse himself from city business regarding his employer.

City Manager Steve Kennedy decided on July 6 that all emergency calls must be dispatched to MetroAtlanta Ambulances rather than Georgia EMS.

Mathews is employed by MetroAtlanta Ambulances, and Ermutlu complained this was a conflict of interest.

The other board members are Chairwoman Terri Copeland, Ed Moses, Robert Quigley and Kenneth Westmoreland.

Copeland said she was surprised by her colleague’s resignation.

“I have enjoyed serving on the board with her and thought she had a great background for the Board of Ethics,” she said. “We’ll miss her and hopefully she’ll get back on another board in the city.”

Copeland said Alberstadt seemed quiet and wasn’t agitated by the hearing or the discussion about the mayor’s ethics during the meeting.

“We were all interested and focused on putting our best effort into reading through the document,” she said. “It was our first time to sit down together and go through it.”

Additionally, Copeland said the mayor’s hearing was only the second she’d been a part of that resulted from a complaint since being appointed to the board in 1995.

Mathews said Alberstadt’s resignation was unfortunate.

“She is a great representative of our community and was placed into a position that she indicated that she wanted to serve,” he said. “One would have to assume that if you are appointed to an Ethics board that you will be hearing ethics complaints against elected officials.

“Having to consider ethical complaints is not an easy position to be in,” he said. “Unfortunately in this case, the accusations were made public as if they were valid claims. The first step of the board of ethics was to determine if the complaints are warranted. Unfortunately, thanks to social media and print media, the case had already been tried, and in the minds of the majority of the “concerned” people in attendance at the meeting had been convicted, and thought they were going to witness a confirmation of conviction and penalty.”

Alberstadt was appointed to the ethics board by the City Council in 2006, Mathews said.

Alberstadt’s position does not need to be filled anytime soon but Copeland would like to have someone in that position before their Oct. 16 regular meeting, she said.

“(A Kennesaw resident) can approach a council member or the city clerk and let them know that they are interested,” she said.

The group holds two regularly meetings annually and gathers anytime there is a complaint filed.

Nowhere in this article did it state that Ms. Alberstadt voted WITH the ethics board to dismiss the complaint. Her reason for resigning was that she didn't feel comfortable with the council members present. Unless my civics classes were wrong, we here in the US tend to allow the "accused" to be present.

I'm no Matthews fan and agree that people in power have influence over others that isn't always in full view of the public. In this case though, the board (all or almost all of whom pre-date the current mayor)voted unanimously that no technical ethics violation occurred. That included Ms. Alberstadt. So, "Well done Eileen" would suggest she did the right thing by dismissing the complaint.

I agree with Eileen when it comes to the Council people being there and their families. Duckett was there and when Chris Welshs husband and parents strolled in like they were royalty everyone noticed. No wonder Eileen fealt pressured.

Ms. Alberstadt was intimidated by Mark Mathews being in the audience?

What in the world did he do? Threaten to sit on her!!!

I know that would intimidate me .

Either that or facing the dilemma of paying for his lunch tab.

How did Eileen get on an ethics board? I guess Kennesaw doesn't check who they put on these boards.

Had Ms. Alberstadt truly had the strength of her convicitions she would not have resigned. She should/would have kept and used yher position to make change rather than wuss out! In essence, she is part of the real problem and a cowardly discrace to Kennesaw.

I do you recall you made a statement of wuss-out. On the Ethics Board, at the meeting there were City and State Ethics Complaints which did not pertain to Mr. Mathews. I can do more off the board than on the board. I plan on doing lots of research and helping to rewrite the rules which will pertain to everyone. The rules do need revamping. I have many years in the legal field and I will do what I can to make sure that this does not happen again. I will also make sure that when an attorney is appointed that he is not from the same county. I feel that was very wrong. We were led like little puppies. I knew the ethics rules for my city and none of which pertained to Mr. Mathews. I also feel that City Officials should not be present and if so, all phones and Ipads should be turned off. I have just resigned from that board, but; I am not gone. I love my city. I stay involved and volunteer when and where I can. Check out who led the Butler Creek Clean-Up after the major flood. I led the team and worked day and night. I am not a wuss and will help anyone I can if they are in need. I belong to my local Civitan Group and Friends of the Georgia Symphony. So I think my record of helping speaks for itself. I am not a coward or a disgrace to my community. If you need help, just ask. Have a great day.

Matthews and the City Manager need to go-where is the leadership on the City Council? Kennedy was at the helm when the city was sued for racism in the public works department and he's still here. Perhaps Kennedy is the real mayor and the rest are puppets.

....and this is why some of us are leaving Kennesaw. Lived here over 30 years but now moving due in part to the constant shenanigans of Matthews and his band of cronies....bad part is....those people in legacy park will never get it until it is too late....Well done Eileen.....

*Conflict of Interest* is defined to describe the situation in which a public official or fiduciary who, contrary to the obligation and absolute duty to act for the benefit of the public or a designated individual, exploits the relationship for personal benefit, typically pecuniary. This includes when a public official’s interests are contrary to his/her loyalty to public business.

The email in question you know the only one the Mayor sent from the city computer, mistakenly? It went something like this; I AM STILL PLAYING THE POLITICS CAREFULLY IN KENNESAW, WILL GET A MEETING SOON WITH PETE AND STEVE KENNEDAY...

Yes, Kennesaw was violating the state law with ambulance services, but the question is they had been violating it all the way back to 1998, when the Mayor was a councilmember. It was not until he excepted a job with Metro Ambulance Service in 2009, that this became a violation of the state law.

So, as I try and understand all of this, so Kennesaw violated the law for 14 years and know all of a sudden they want to follow the law as it was 14 years ago, now is it because the Mayor works for that service, it's time to be lawful.

All I can say is you politician are sure showing the children of today how to conduct themselves in the business world. You should be ashamed of yourselves and the examples you are setting.

Good luck to the city employees, residence of Kennesaw. You seem to work for some evil individuals who are out for themselves.

Okay, I don't live there, nor will I any time soon and I agree with you on many points but to say the Mayor started working with Metro Ambulance Service in 2009 and then turn around and say all of a sudden? 2012 minus 2009 is 3 years. It should be obvious that the Mayor did nothing all of a sudden.

You have an axe to grind somehow. Now who's teaching our children how to conduct themselves. Apply some common sense.

And it was not up the mayor to make the city of Kennesaw abide by the 911 zoning law. The onus was on the provider, Metro, to appeal to the State to MAKE the City of Kennesaw comply with the law. Previous 911 providers didn't want to "make waves"

@ applyingcommonsense..He was a councilmember that fought for GAEMS back in 1998 based on earlier articles...That is how I came up with that you buffon..Guess you are a supporter or current councilmember..I just think ethics and morals has been lost in the government world...No axe to grind as you say, but to flat out lie and talk about something you fought for years ago and now you are all for following the law...Please tell me you are smarter than that...Good day

I was at this meeting. The Ethics Board were advised by a lawyer the whole time. According to the lawyer present none of the complaints were valid at the city level, they should be state level. The Board did a great job.

I think there should be Mayor Matthews recall. If what he did wasn't ethical it was definatley morraly reprehensible.

No dog in this fight - but consider what you might expect with a Board which was appointed by the Mayor and Council taking up a complaint against the Mayor.
