Police arrested John S. Kristofak, 58, at 3:30 a.m. in a Motel 6 south of Atlanta. Kristofak was charged with murder and aggravated assault related to Saturday’s stabbing death of his ex-wife, Donna Nations Kristofak, 48, in the 3900 block of Tall Pine Drive near Walton High School.
Officers with the Cobb Sheriff’s Office Fugitive Unit, the U.S. Marshals Southeast Regional Fugitive Task Force and Union City Police participated in the arrest.
After surveillance of the area, officers entered the motel room and arrested John Kristofak after a brief struggle. A small caliber handgun was found in the room.
“He was non-compliant to an order given by police officers,” said U.S. Marshals Supervisory Inspector Gavin K. Duffy. “We certainly surprised him, but the lights were on in the room when we went in.”
Duffy credited Cobb investigators with leading the way toward locating John Kristofak.
“I believe they did a pretty good job keeping an eye on him and staying a half a step behind him,” Duffy said. “It was an outstanding job by the Cobb County Fugitive Unit. It was a team effort, and that’s the only way somebody like this gets taken into custody.”
According to police, Kristofak, a resident of Acworth, faces an additional charge for a probation violation related to his October conviction for aggravated stalking and family violence simple battery charges. Superior Court Judge Adele Grubbs sentenced him to four years and five months probation and seven months in jail, most of which he had already served. He was also barred from having contact with Donna Kristofak.
John Kristofak, originally from Connecticut, is registered to sell life and accident and sickness insurance with the Georgia Office of Insurance and Safety Fire Commissioner.
Despite numerous media reports relaying police information that Kristofak was last seen driving a brown Chevrolet Equinox, Duffy said the suspect still had the vehicle parked outside his motel room.
“We certainly use that as a clue in our business,” he said.

Cobb is becoming Fulton, DeKalb and Clayton County. Our Judges are giving light sentences and letting criminals walk in all sorts of crimes.
One major part of the problem is the Chief Magistrate Judge Cox. He is the gatekeeper and often lets hard core criminals out after arrest with OR bonds or very low bonds, because his friend defense attys are appointed the case.
Judge Grubbs just did what every other superior court judge in Cobb would have done. The system is broken. We need to send criminals to prison. We are getting to liberal with our justice system.
We will only see more of this. The Gov just pasted a new criminal justice reform law, letting even more criminals walk after weak sentences for non-violent crimes... I.E. Burglary, and Illegal drugs, so called "non-violent" crimes.

However, playing devil's advocate here, Judge Grubbs also had to be fair and just in her sentencing as Kristofak had no prior records of violence, etc. and no arrest record. He had been held on the stalking charges on $250k bond and could not make bond. This is why he sat in Cobb for 7 months awaiting trial.
It is up to us citizens of Cobb to demand our representatives that we vote into office write & pass legislation for mandatory minimums,counseling and also victim assistance and relocation, etc. when any act of violence is commited.
