Council reviews 'So Help Me God' oath

MARIETTA - City Councilman Van Pearlberg objected this week to the phrase "So help me God" included in the oath of office that Marietta police officers are required to say.

Pearlberg, a senior assistant district attorney, said it's been his experience that when citizens take the stand from time to time, making them swear to God can be a problem.

"A lot of people won't swear on a Bible. Their religious beliefs won't allow them to swear," Pearlberg said.

The topic was raised by Pearlberg during the Council's Public Safety Committee on Thursday as the committee reviewed potential changes to the Marietta Police Department's operating procedures.

Staff had asked the council to allow any certified notary designated by the police chief to administer the oath as opposed to the current policy, which requires the mayor, mayor pro tem or mayor's designee to administer the oath.

In reviewing the oath, Pearlberg noticed how it ended with the statement, "So help me God."

"It's a diverse population and a lot of people have diverse beliefs, and as a result I would not want to lose a potential officer as a result of that," Pearlberg said.

Mayor Bill Dunaway said in his eight years of administering the oath to police officers, the phrase has never caused a problem. But Councilman Philip Goldstein said just because no one has objected is not a sufficient reason to leave it unchanged.

Goldstein said city attorney Doug Haynie could come up with language to allow the police officer to say something else in the event the person didn't want to swear to God.

City Manager Bill Bruton said Haynie will bring back revised language to the council's committee meeting next month for consideration.

Pearlberg said after the meeting he was satisfied with allowing a second option to be said.

"In the court the phrase is, 'do you swear to tell the truth, the whole truth, nothing but the truth, so help you God,' and at times people will say 'I will affirm,' so when I saw this my thought was what happens if somebody based on their religious beliefs doesn't want to swear? Well, there's no provision there that says they can affirm. We might be in a situation where we lose a police officer," Pearlberg said.

Yet Councilmember Anthony Coleman, who chairs the Public Safety Committee, is adamantly opposed to any changes to the oath.

"What's the justification for taking it out? Just because some people don't want to recognize God? We are a Christian nation," said Coleman, a pastor at Visions for Souls Church in Mableton.

"When you're swearing to someone you're making a binding oath. That's something that should not be taken lightly. When people make a binding oath they need to know how it lines up biblically with the word of God. Marietta has had that oath of office in place for years. It goes back to we are a Christian nation," Coleman said.

As for having a certified notary administer the oath rather than the mayor, Dunaway objected to that change, saying he liked having the new police officers come before the council to introduce themselves.

I find it very interesting that Mr. Panetta is thanking God for the MFD and the MPD when he has publicly stated that he is atheist. This is so hyppcritical and that is the problem with politics as usual which seems to be the issue with the "oath" in general. If people would state what they truly believe instead of what they think folks want to hear, we would not be having these debates...period...

Who Died and left Phillip Goldstein and Van Pearlberg(Moe & Larry)in Charge? The brainless ego's of this clearly mis-guided,inept, self-serving duo is mind-boggling! We should all "Thank God" for the Men & Women of this City who put their lives on the line every day for us! To suggest that a City in a State & Country founded on Christian Beliefs & Principles with close to 90% of the Population still endorsing & subscibing to those same beliefs & Principles change after nearly 175 years is crazy!!! Why change what clearly has worked well for so long now? What motivates Moe & Larry, aka Pearlberg & Goldstein? I hope(& PRAY)our neighbors in their ward's will remember this prior to election time...

What is sad is the arrogance of the Mayor and Councilman Coleman. Politically Correct? I am not a fan of being "Politically Correct" and neither am I a Liberal. Yet this situation goes beyond this. This situation is dangerously close to causing a major uproar. The Mayor himself stated that if someone cannot swear before (his) God then he isn't sure he even wants them on his Police Force. How utterly ABSURD.

We are NOT a Christian Nation, we are a FREE nation where you cannot hold another person back because of which God or lack thereof they support. We do not hold Christian Trials, we do not endorse Christianity as a nation over Islam, Judaism, etc. We have Laws of the People, by the People, and for the People.

To publically state that you wouldn't want someone on the Force because they do not believe in your God is a violation of who we are as a country. How would you like it if we forced you to swear to Allah or swear to the Flying Spaghetti Monster? It's ridiculous.

As a member of the City of Marietta Civil Service Board, I fully support our Fire and Police Departments, including their core values and beliefs. They put their lives on the line for us daily and I thank God for them. Many of them have very strong faith and it sustains them through the difficulties of their work, and they are among the most professional, courteous, and hard-working, people you will ever meet. We citizens have good reason to take pride in our "All American City" status. Unfortunately we often forget to give the MPD and MFD the recognition they deserve for the contribution they have made for that award. We have nothing without safety. “Second guessing" our procedures or become too politically correct for no apparent benefit, deteriorates a system that has been very successful for Marietta. The first law of engineering is, if it’s not broken, don’t break it. For that reason, I pose the following question. Does anyone believe that the City of Marietta is deprived of ONE quality candidate because they are made to say “So help me God”? The answer is no, and I also contend that many other candidates would gladly step up and repeat those words proudly to become part of a city that is recognized across America for it’s overall excellence.

Why change what has worked for so many years ? I can agree that is a person does not believe in God then maybe they could take an oath to something else. I see this nation getting weaker instead of stronger due to to much change. Yes change can be good but not all change is good. Is it not bad enough that when you shop for Christmas gifts you are told Happy Holiday and not Happy Birthday Jesus (also known as Merry Christmas) Though I am not super relieagus I am a believer, and one simple truth is God has been good to this Nation we should as a Nation founded by Good Men of God be thankful and Good towards him.

May all have a Blessed Thanks Giving a day that we give thanks to the very God that it seems many want to take out of everyday life.

Mr. Coleman, the United States, along with first being a Christian nation, was also a nation that did not have elected Senators, did have slavery, did not allow women the right to vote, and on and on. Get over the fact that this nation was a Christian nation. My God, the God who speaks to me through my NIV bible, is probably okay when people accept people of other faiths and beliefs.

Kind of funny Ol' Pearl waited until after the election to list this as part of his platform. He must be betting on the idea that the voters will have short memories when he seeks re-election. P.S. In the U.S. Constitution, it clearly states that we get our rights from our creator (God). As a result, man does not have the right to take them away. Final Question on this test: Are not the the police officers swearing to uphold the Constitution (via the 14th amendment?) of the United States as well as the state of Ga.? Hope you have fun explaining that one in the next election cycle or to me when I see you on the square next time I see you.

It's too bad he's so p.c;(afraid our atheist and Muslim,etc.friends might be offended?)and that I didn't get to vote him out of office. What else does he propose to do next-cut out the words,"In God We Trust" off our money?

Shame on you. Why did you not do this PRIOR to the election? Answer; You know you would never have been re-elected. Your responsibility is to your constituents and I would imagine that the majority of them would be very dissapointed in your disgusting view. If you feel this way, please back to New York and destroy their values system, not ours. Mayor-elect Tumlin remember "In God We Trust" is a tenant foundation of the United States and ignore the stupidity of Van "Athiest" Pearlburg.

God would rather you swear at him than say nothing at all. Keep taking God out of everything and see what happens. It is only going to get worse and worse. See education for example. Diverse or not, we are still built on Christian principles.

The MDJ needs to explore the two oaths that Van took to become an ADA for Cobb County and a councilman with the city. God in this oath is universal to all faiths. I also like they way Van didn't bring this up until after the election. Talk about hidden agenda's.

A very minor issue which happens to make for good newspaper copy. Van's point is well made and intended. If he truly wants to insure Marietta does not lose a good police recruit, he should insure that Marietta offers excellent pay and benefits.

I personally would want my officers to acknowledge that they answer to a higher power. But of course, any lawyer with too much time on his hands can mess with that concept indefinitely.

So help me God, Van Pearlberg is right! Article VI of the Constitution of the United States states that all state officers shall be bound "by Oath or Affirmation" to support the Constitution and that no religious test shall EVER be required as qualification to any public office. Thus an affirmation is sufficient. The same legal penalties apply to false affirmations as do to false oaths, so affirmations are to be taken as seriously as oaths. Van is just reminding us of what is already in the U.S. Constitution that his fellow council members have all sworn to support.
