MARIETTA - Advocates for the Latino community said they are investigating alleged incidents in which Cobb public safety officials have violated due process for Latinos and immigrants, but Cobb officials maintain the county enforces the law without regard to race.

"The sheriff thinks he's living in the wild-wild West," said Jerry Gonzalez, executive director of the Georgia Association of Latino Elected Officials. "It appears that they've stepped up with any contact they make with immigrants, particularly undocumented immigrants. They're sending them to jail so they can deport them."

Gonzalez sent a mass e-mail Thursday that noted "several jurisdictions" in which individuals, who were victims of crime or in car accidents, contacted police, who then questioned the individuals' immigration status and detained them.

"Unfortunately, this is going to harm public safety for Cobb County residents, because they are driving the immigrant community underground," Gonzalez said. "Crime, suspicious activity isn't going to be reported."

Gonzalez further wrote that family members are not being allowed to visit people who have been arrested for minor traffic violations.

"Family members are afraid," the e-mail reads. "Cobb County Jail officials have allegedly told people visiting these arrestees that because they are 'illegal' they have no rights."

Chief Deputy Sheriff Lynda Coker said she didn't know where Gonzalez was getting his information.

"The personnel at the jail work very hard to make sure rules and regulations are understood," Ms. Coker said. "I would like to know the name of an employee who told anyone who came into that facility inquiring about a family or loved one that they have no rights because they are not legal, because that is absolutely not the case. That kind of an allegation causes me great concern because it is off the cuff."

Ms. Coker said normally, when an inmate is brought into custody and then detained, after five days, they put individuals on a list for visitation. Visitors must have identification when they come to the jail.

"It's not just an open facility like a hospital where people just come and decide they want to visit a family member," she said.

Ms. Coker added that with 2,300 inmates, "it's an enormous process to try to allow visitation," which varies based on where inmates are located in the jail.

"We generally are very generous with visitation," Ms. Coker said. "All inmates are afforded the same opportunities, regardless of their charges."

Ms. Coker said as of Oct. 8, the jail had 447 inmates in custody who had a U.S. Immigration and Customs Enforcement hold on them. Since July, the Sheriff's Office has been keeping statistics on jailed illegal immigrants and is now trying to develop a monthly report.

Between July 1 and 23, Cobb jail officials and ICE interviewed 86 inmates, placed immigration holds on 68 and started deportation proceedings against 42.

The Cobb Sheriff's Office in early June began screening Cobb Jail inmates to identify illegal immigrants and initiate deportation procedures after several deputies completed federal certification to do so, per Section 287(g) of the Immigration and Nationality Act of 1996

Cobb Chairman Sam Olens said the Cobb Police Department and Sheriff's Office treat everyone the same, whether Hispanic, Caucasian, or any other ethnic group.

"It is my expectation that (Cobb public safety officials) will fully comply with the laws of this state and country," Olens said. "There is no distinction between how anybody is treated once they are in that jail."

Olens did agree with one thing Gonzalez wrote in his e-mail: a statement encouraging people not to drive if they do not have a driver's license, as the "minor traffic violation has lead to several detentions, deportations and separation of families. Do not drive without a license, especially in Cobb County," Gonzalez wrote.

"No one without a driver's license should be driving," Olens said. "I certainly applaud that position."

Gonzalez further refers anyone in Cobb who has experienced any type of discriminatory practice or possibly illegal abuse to the Atlanta offices of the Los Angeles-based Mexican-American Legal Defense and Educational Fund, or MALDEF, and the Georgia Latino Alliance for Human Rights.

MALDEF Regional Counsel Elise Shore said her office is involved in looking into the allegations, which include jail inmates being denied the right to talk to their clergy.

"We will seriously investigate allegations that we're receiving about due process and violations of people's religious liberties, which could be a violation of the Religious Land Use and Institutionalized Persons Act," Ms. Shore said.

Organizations like those of Ms. Shore and Gonzalez are in the process of organizing alleged discriminatory and unconstitutional practices spurred by 287(g) and the implementation of state Senate Bill 529, the Immigration Compliance Act, which passed in the 2006 legislative session.

It's important to investigate the allegations, she said, "because these are people's lives and families at stake."

Mr.Gonales.Mrs. Shore & Mr Jamie Herndan, You guys are like crabs--little annoying parasites. Do you REALLY care about the "illegal" immigrants that are invading "our" country? Well, if so, go to the Mexican government, & DEMAND that it begin to respond to it's masses of humanity that are 'seperating' from their families to come here to earn more than what they're used to there- $4.oo a day! All groups such as GALEO, MALDEF, & LARAZA (which stands for the race), are doing, is encouraging lawlessness & anarchy in "our" country, in search of POWER!! It is NOT o.k. for one certain sector of our society (25-35 million illegals)-- to continue living outside of our laws. It is NOT ok for them to steal Americans social security numbers & deceptively retain employment in "our" country. It is NOT o.k. to drink & drive, hit someone, & get out & flee! It is NOT o.k. to pack 10 'workers' into one house, paying 500.00 a month rent (which comes out to investors making a whole lot of undocumented cashola), in our once beautiful, peaceful, quiet neighborhoods! It is NOT o.k. to invade "our" country, take "our" jobs, destroy our neighborhoods, disrespect "our" police officers, & poison "our" society w/ criminal activity, & then call it "civil right"! Americans respect, encourage & ADMIRE Sheriff Neil Warren, the Cobb County Commisioners who are upholding the law & Constitution, & the Cobb County Police Department, that are having to spend time on the 'front lines' every day! Ms. Shone and Gonzalez stated "because these people's lives and families at stake.. What about everyone else lives and families? Don't matter what race or color you are, if you not not license to drive, then don't get behind a wheel of a car. If you are license to drive, then get car insurance for your protection and others? I have visit the county jail to see people and I was treated respectfully and yes, I do have to show identication. If I was to end up in jail in latino countries, what laws applied to me and my right? I always understood that driving is a privlege not a "right".. The immigration laws are here because of a reason. I didn't vote on it but we do have a problems and we all need to work together in solving issues. Not play the race game and saying our sheriff is like the "Wild West".

Jerry need to go back to where ever he came from. Illegals have no rights under the Constitution of the United States, because they are illegal. The ACLU needs to keep their nose out of it also. As far as I am concerned the illegals are fair game for the legal authorities to arrest them, deny them bond or a trial (actually we cannot take them to trail because the law says "by a jury of your peers" so the jury would have to be made up of illegals.) Catch them and deport them, plain and simple.

Jerry Gonzalez does not live in Cobb County. He does not work in Cobb County. He does not vote in Cobb County. He does not pay taxes in Cobb County. Those citizens, emphasis on citizens, who do pay taxes and travel on the roads, also vote in Cobb County. We love Sheriff Warren and wish the rest of the country would get with the 287(g) program, because our country would be a great deal safer. If you do not have a driver's license, you do not have insurance, because insurance will not cover an unlicensed driver. Having been hit by an illegal alien, I am an expert on this. And that illegal ran like a sissy coward, leaving his teen wife and baby in the car. The taxpayers have to pay their deductible, their insurance premiums go up, and our roads have become killing fields for drunken illegals. If you are here illegally and do not like the laws of our country, then go back and fix the problems in your country of origin. The American citizens have spoken loud and clear with every attempt to skirt our laws and our sovereignty, and we have won in spite of sorry judges, La Raza, GALEO, MALDEF and the ACLU. We can recognize your race bating tactics Mr. Gonzalez, but the fact is that not every illegal alien is Hispanic. This newspaper and the others should not give a voice to such racist organizations as MALDEF and GALEO.

All persons, regardless of citizenship or immigration status, are entitled to due process according to our laws and our U.S. Constitution. Law enforcement officials must live up to this part of the rule of law as well and we are watching closely. Based on interviews we have conducted, violations are likely occurring.

First of all, no one is illegal--everyone is human. Some people have committed illegal acts, as does anyone who exceeds the speed limit by one mile per hour. So if anyone is illegal everyone is illegal. Calling anyone an illegal immigrant is insulting and untrue just like calling an Italian (my family) a WHOP (which means without papers) or a Black the N word or on and on... Secondly, coming into this country without propoer documentation is not a criminal act--learn your law--it is a civil matter, just like a lawsuit or a divorce--so even technically there is no such thing as an illegal alien or person or immigrant. Calling names is just a way to make someone feel above or superior to another human being. So the first step is to stop accusing and calling names--then we can have a dialogue about how to treat humans humanely, including ourselves. Thank you Sheriff Warren, Deputy Sheriff Coker and all Officers for upholding the law. America needs more people like you. We must also focus on employers of illegal aliens. No work or social services = self deportation. Thank you Georgia for enacting common sense proof of legal residency requirements for the PRIVILEGE of obtaining a drivers license in this state. WAKE UP AMERICA. THIS IS NOT IMMIGRATION, IT'S AN INVASION!

They have been paying their dues to this country ever since they got here by working on the farms, in the chicken factories, in construction, for low wages so that you and I have a higher standard of living. They have been paying their dues when they came here, at the invitation of Georgia and the Federal govt., to build the infrastructure of the Olympics (which was behind schedule and it is common knowledge that they saved the day). They have been paying their dues in Cobb County and GA and the U.S. by contributing millions more to the tax rolls and economy than they take out (by the assessment of every independent audit, including that of the State of Texas and the IRS); they have been paying their dues by having children here (who are U.S. citizens) who are learning the language and excelling in school. I can go on and on, but they have been paying their dues just like the Irish, Germans, Italians, Asians, Africans and every other immigrant group has done before. It is time to recognize that and welcome them as new neighbors and give them a pathway to citizenship, which the next wave of immigration reform will do as every mainstream Presidential candidate has promised, from both parties. In the meantime, it is the duty of every resident of the U.S. and Cobb County to welcome and protect them as neighbors - by the rules of common sense (because they will never be deported except for a handful), by the rule of basic human decency (because they are human beings with families just like you and I; having a paper or a passport doesn't make anyone less or more of a human); and by the rule of Christianity (as the Bible says in many places to welcome unconditionally aliens from foreign lands and I am happy to see that the Southern Baptists and other evangelicals are beginning to recognize this and reach out to welcome them). So it is a massive waste of energy, time and money to even think that they are going to leave or be forced out - let's sit down as Americans and work out a win-win situation where everyone wins. This is a catch-22 which always happens when politicians overstep their bounds and their misguided actions cause a whole stream of unintended consequences. Most immigrants would love to have drivers licenses (and many without licenses still have insurance) however GA will not issue one without a SS#. (Other states do because they realize it is a public safety hazard to have people driving without licenses.) Undocumented immigrants cannot get a SS# until the federal govt. passes immigration reform laws. A vocal minority are opposed to immigration reform so they try to block the federal govt. from passing it. Then the states and towns get frustrated because the federal govt isn't acting so they pass unconstitutional ordinances targeting the immigrants and other restrictive laws. All of this is done under the guise of "the rule of law" yet the effect of all of this is anarchy, driving a large minority group further underground, which encourages crimes against them and the formation of gangs to protect themselves, and this all results in more crime against the immigrants and against everyone - including you and I - because the criminals of all races take advantage of all the confusion. Law enforcement, is trying to build trust with the community so that people report crimes and witnesses come forward however when one segment, in this case, the Sheriff, starts acting as an immigration agent rather than as a County law enforcement officer, then the trust is broken with the Police Dept and we have further anarchy. It is time to have a sane and unemotional dialogue to fix these things, without hate rhetoric directed towards anyone and without name calling.

This has nothing to do w/ calling anyone names, or disrespecting people of particular ethnic backgrounds,.... it's all about the POWER that is accumulated by having a strong 'voting' latino population. The $$ backing this "invasion" is no doubt extravagent - it comes from many sources - i.e. - Jane Fonda, State Farm Insurance, & yes,... the drug cartel. This is a war, & the enemy is using propaganda & psychology - ah... the poor little, starving immigrants, just want a better life.....not so fast .....juan (in that big, new $50,000 truck).....we ALL want better for our families,.... doesn't mean we just go a TAKE what we want from others to achieve it! In OUR country,... we call that STEALING,... & it IS a CRIME! And Rich, for you to stand there today, in your $800.00 suit, financed by GALEO & LARAZA, & try to run those lines on us (the minutemen) - you sounded awfully ludicrous,...not to mention,.. bought, & paid for. Why don't you have that "dialog" w/ Deputy Loren Lilly's wife, or Dustin Inmans parents? The founders of our country clearly stated that persons from another country of origin not a citizen and baby born on American soils was to be claimed only by that country of origin not of the USA. Protect the 14th ammendment! Illegal aliens have no claim. See Websters Dictionary and remember follow the money trail from Rich Pellegrinos wallet and Senoir Jerry Gozo! The largest group in America to be affected by illegal migration from the southern border of the United States are black American citizens all over America including Atlanta, Ga. Our Constitution has beed threatened by illegal lobby groups and fake non-profits. As long as pilgram1 aka Rich Pellegrino and other money hungry people keep fighting against laws already in place low income and homeless will grow inside America. Our rights as United States citizens have been violated by many in the public arena. It is the right for all cities and counties government to enforce immigration laws and bring the 287(g) program into the city and county. Americans are wide awake now! Protect the 14th! Ninety billion was spent with US tax payers for illegal aliens and we have more than two million homeless Americans and growing. The racism is coming from the supporters of illegal aliens!
